ZBA Minutes May 27, 2010
The Zoning Board of Appeals of the Town of Avon held a meeting on Thursday, May 27, 2010 at the Avon Town Hall.  Present were Messrs. Ladouceur, Johansen, McNeill, Ms. Hard and Mr. McCahill, Planning & Community Development Specialist.  

PUBLIC HEARING                                                                      May 27, 2010

Mr. Ladouceur called the meeting to order at 7:35 p.m.  He said usually this is a five member board.  There is a fifth person expected but is not here yet.  You need four votes to approve an application.  With a four member board the vote must be unanimous.  He asked the applicants if they would like to proceed with a four member board or continue the application until the next ZBA meeting when five members are expected to be present.  Mr. & Mrs. Bouchard both agreed to have their application heard tonight.  
 
The clerk read the call to meeting.

Mr. Ladouceur read the Application of Gregory & Margaret Bouchard, owner/applicants; requesting from the Avon Zoning Regulations Sections III.C. & IV.A.6., a 23’ variance from the 25’ side yard requirement to square off and raise the roof from 9’ to 15’ on a nonconforming garage, located at 152 Arch Road in an R-40 zone.  He also read an e-mail from William and Mary Ann Berg, 156 Arch Road with NO objections to this application.

Mr. Bouchard stated the garage was built almost on the property line.  It was built only 6’ high, taller people could not stand up straight without hitting their head.  They request to raise the roof so they can put in a garage opener, the present flat roof is leaking.  They request to raise it 3.5’, then a pitch on the roof so it will flow better.  The proposed front of the garage will look almost like the front of the house.  There will not be a second floor on the garage.  At present they have a blue tarp to protect the garage from the leaks.  The only part that will not be raised is directly next to the house, about 15’ along a steel beam.

There was no one else present.  The Public Hearing closed at 7:47 p.m.

ZONING BOARD OF APPEALS MEETING                                 May 27, 2010

A Zoning Board of Appeals meeting was held following the Public Hearing.

Ms. Hard made a motion to GRANT, seconded by Mr. Ladouceur, the Application of Gregory & Margaret Bouchard, owner/applicants; requesting from the Avon Zoning Regulations Sections III.C. & IV.A.6., a 23’ variance from the 25’ side yard requirement to square off and raise the roof from 9’ to 15’ on a nonconforming garage, located at 152 Arch Road in an R-40 zone.  The vote was unanimous by Messrs. Ladouceur, Johansen, McNeill and Ms. Hard.

Reason – To grant variance is in harmony and keeping with the purpose and intent of the regulations and would not be injurious to the neighborhood.

Hardship – To deny would deprive the owner of a reasonable use of the property.

There being no further business the meeting was adjourned at 7:50 p.m.
